Terms and Conditions (T&C)
last updated : 30/08/2025
These Terms & Conditions (“Terms”) govern all inquiries, orders, and purchases made with EPPIC, operated by Sascha Epp, sole proprietorship (entreprise individuelle), located at 5, rue des Tondeurs, L-9570 Wiltz, Luxembourg.
By placing an order with EPPIC, you (“the Customer”) accept these Terms in full.
1. Scope of Services
EPPIC provides fully customized, hand-painted artworks created according to customer specifications.
All artworks are individually crafted and therefore considered custom-made products under EU consumer law.
2. Orders
Orders are initiated via contact form, email, phone, or social media.
A project is considered confirmed only once the deposit (see section 4) has been received.
EPPIC reserves the right to refuse orders that are inappropriate, unlawful, or technically unfeasible.
3. Pricing
Prices are quoted in Euro (EUR) and may vary based on size, complexity, and specifications.
Prices include delivery and packaging unless otherwise specified.
Framing/stretching options are available at additional cost.
4. Payment Terms
For non-portrait artworks, a 30% non-refundable deposit is required to start production.
For portrait artworks, a 50% non-refundable deposit is required to start production.
Production begins only after the deposit has been received.
The remaining balance must be paid before shipping/delivery.
Accepted payment methods: bank transfer (SEPA), PayPal, Payconiq, or cash (Luxembourg delivery only).
5. Cancellation & Withdrawal
As the artwork is custom-made, the EU 14-day right of withdrawal does not apply.
Once production has started, cancellation is not possible.
Deposits are non-refundable, except in exceptional cases where EPPIC decides not to proceed with the order.
6. Quality & Customer Satisfaction
At EPPIC, customer satisfaction is at the center of our work. We discuss your wishes carefully before production begins to ensure your vision is understood. Each painting is handmade, which means natural artistic variations in color, composition, and style are to be expected. It is important to note that a painting is not a 100% copy or print of the Vorlage/reference provided, but an original interpretation created by the artist.
Clear errors by EPPIC:
If the artwork substantially deviates from the agreed concept due to an error by EPPIC (e.g., wrong subject, wrong size, clear failure to follow agreed instructions), EPPIC will first attempt to correct the issue in consultation with the Customer.
If no solution can be found, the Customer is entitled to a 100% refund of all payments made.Rejection for subjective reasons (personal taste):
If the artwork matches the agreed concept but the Customer rejects it for reasons of personal preference, this does not entitle the Customer to a refund.
Examples of subjective reasons include (but are not limited to):Colors appear brighter, darker, or slightly different than expected.
The artistic style, brushwork, or texture is not exactly as imagined.
The composition or proportions differ slightly from the reference image.
Certain details are emphasized or interpreted differently by the artist.
The overall “feeling” of the artwork does not match the Customer’s personal expectations.
In such cases, EPPIC will always make reasonable efforts to adjust the artwork at no additional cost, in dialogue with the Customer, to achieve the best possible result.
However, if the Customer still rejects the artwork:
For non-portrait artworks, EPPIC will retain the 30% deposit as compensation for time, effort, and materials. The artwork remains the property of EPPIC and may be resold or reused.
For portrait artworks, which are highly personal and cannot be resold, EPPIC may retain up to 50% of the total order value (corresponding to the deposit). In such cases, the rejected portrait will not be resold but will instead be destroyed by EPPIC.
Other reasons (damage, delays, etc.):
In the event of damage during shipping or other objective issues, please refer to §8 (Returns & Refunds).
This policy ensures fairness:
Customers are fully protected if EPPIC makes a genuine error.
Customers are respected and included in the process, with free adjustments where possible.
Artists are protected against unfair rejection while keeping customer care as the main focus.
7. Delivery
Delivery is free within Luxembourg (stretched/framed).
Worldwide shipping is included (art shipped unstretched and unframed unless otherwise agreed).
Estimated production + delivery time is 6-12 weeks but not guaranteed.
EPPIC is not responsible for delays caused by shipping providers, customs, or force majeure.
8. Returns & Refunds
Returns are not accepted for custom artworks.
Refunds are only possible in case of:
Severe damage during shipping (must be reported within 5 days of receipt with photo evidence).
Proven failure by EPPIC to deliver the agreed subject/size (see §6 for quality issues).
9. Copyright & Intellectual Property
The Customer guarantees that they have the legal rights (copyright, license, or permission) for any image, photo, or reference provided to EPPIC.
EPPIC is not liable for copyright violations caused by Customer-provided material. The Customer accepts full responsibility in such cases.
Unless otherwise agreed in writing, EPPIC retains copyright over the created artwork.
The Customer may display the purchased artwork privately but may not reproduce or resell it without permission.
EPPIC reserves the right to use photographs of the completed artwork for portfolio and marketing purposes, unless the Customer expressly objects in writing before production begins.
10. Liability
EPPIC’s liability is limited to the amount paid by the Customer for the artwork.
EPPIC is not responsible for indirect losses, shipping delays, or external damages beyond its control.
11. Governing Law & Dispute Resolution
These Terms are governed by Luxembourg law.
Any disputes shall be settled in the competent courts of Luxembourg.
12. Updates to Terms
EPPIC reserves the right to update these Terms & Conditions at any time. The latest version is always available on our website.
